Please read these Terms of Service carefully before using Bekjarska Monitoring. These terms govern your access to and use of our fleet safety monitoring platform.
Agreement to Terms
Acceptance
By accessing or using Bekjarska Monitoring's fleet safety platform ('Service'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, you may not access or use the Service.
Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent. By using the Service, you represent and warrant that you meet these requirements.
Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
Service Description
Platform Services
Bekjarska Monitoring provides fleet safety monitoring, FMCSA compliance tracking, driver management, safety analytics, and related services. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
Service Availability
We strive to maintain 99.9% uptime for our platform. However, the Service may be temporarily unavailable due to scheduled maintenance, upgrades, or circumstances beyond our control. We will provide advance notice of scheduled maintenance when possible.
Support Services
Your subscription includes access to our support team during business hours via email and our help center. Premium support options with faster response times are available for Enterprise customers.
Billing & Payment
Subscription Fees
You agree to pay all fees associated with your selected subscription plan. Fees are billed monthly in advance and are non-refundable except as expressly stated in these Terms. All prices are in US dollars unless otherwise specified.
Payment Methods
We accept major credit cards and ACH bank transfers for payment. You authorize us to charge your selected payment method for all fees due. You are responsible for keeping your payment information current.
Price Changes
We may change our subscription fees upon 30 days' notice. Price changes will take effect at the start of your next billing cycle. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.
Refund Policy
We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with the Service within the first 30 days, contact us for a full refund. After 30 days, fees are non-refundable.
User Responsibilities
Accurate Information
You are responsible for ensuring that all fleet data, driver information, and compliance documentation entered into the platform is accurate and up-to-date. Inaccurate data may result in incorrect compliance assessments.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.
Compliance
While our Service assists with FMCSA compliance monitoring, you remain solely responsible for actual compliance with all applicable federal, state, and local regulations governing your fleet operations.
Acceptable Use
You agree not to misuse the Service, including but not limited to: attempting to gain unauthorized access, interfering with the Service's operation, uploading malicious code, or using the Service for illegal purposes.
Prohibited Activities
Restrictions
You may not: (a) sublicense, sell, or transfer access to the Service; (b) reverse engineer or attempt to extract source code; (c) use the Service to store or transmit malicious code; (d) interfere with or disrupt the integrity or performance of the Service; (e) attempt to gain unauthorized access to the Service or related systems.
Data Integrity
You may not submit false, misleading, or fraudulent data to the platform. Intentionally falsifying compliance records or safety data is strictly prohibited and may result in immediate termination of your account.
Termination
Termination by You
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will be effective at the end of your current billing period, and you will retain access until then.
Termination by Us
We may suspend or terminate your access to the Service immediately if you violate these Terms, fail to pay fees when due, or engage in conduct that we determine is harmful to other users or our business.
Effect of Termination
Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination. After 30 days, we may delete your data in accordance with our retention policies.

THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Compliance Disclaimer
Our Service provides tools and information to assist with compliance monitoring, but we do not guarantee compliance with any regulations. You are solely responsible for ensuring your fleet's regulatory compliance.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEKJARSKA MONITORING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
Maximum Liability
Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
General Provisions
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the AAA Commercial Arbitration Rules.
Modifications
We may modify these Terms at any time by posting the revised Terms on our website. Material changes will be notified via email or through the Service. Your continued use after changes become effective constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
